Introduction

Online Drivers Inc. is an MTO Approved Drivers Education School whose mission is to prepare drivers with the ability to safely operate a motorized vehicle whilst navigating the roadways of Ontario, Canada. All content found on website(s), product(s), and service(s) is owned by Online Drivers Inc. Online Drivers Inc. or this website is not affiliated with any Drive test Center or any other organization, office, company, firm, bureau, business or third party that operates, processes, or evaluates Drivers Licenses or any other examinations related to acquiring a Drivers license in Ontario.

The Online Drivers Inc. Terms of Service (“Terms”) is a legal binding agreement between Online Drivers Inc. and you (the user). These Terms of Service govern your use of Online Drivers Inc. and its products (“Products”) and services (Services). Please take the time to read over the Terms and Conditions carefully. By accessing onlinedrivers.ca or by using any products or services, you agree to be legally bound by these Terms, Privacy Policy, Cookies Policy and Acceptable Use Policy herein. You acknowledge and understand that Terms of Service, Products, Privacy policy, Cookie Policy and Acceptable Use Policy can be changed or altered in any extent. Any changes will be communicated electronically.

Teenagers under 18 years of age

You acknowledge and agree that by accessing or using any of the products or services that you are at least 14 years of age or older. If you are under the age of 18 you must have your parent(s)/guardian(s) permission in order to purchase any product, membership, service, or course. To validate that you have your parent’s permission your parent(s) must register an account with Online Drivers Inc. and are thereby responsible for any purchases made within their shopping cart.

Children under 13 years of age

Any children under the age of 13 (thirteen) are not permitted to purchase any course, membership, or product from Online Drivers Inc. Online Drivers Inc will not collect any information, accounts, or payments in any form from any children under the age of 13 (thirteen).

In-Vehicle Training - Limits of Liability

Online Drivers Driver Training Vehicles are insured. Limits of Liability are as follows: Bodily injury and $2,000,000 property damage inclusive limit combined.

YOU AGREE THAT IF SUCH EVENTS ARISE ONLINE DRIVERS INC. SHALL NOT BE HELD RESPONSIBLE IN ANY MANNER.

IF APPLICABLE LAW DOES NOT ALLOW FOR THE LIMITATIONS OF ALL OR CERTAIN LIMITATIONS MENTIONED HEREIN. THEN ONLY THE APPLICABLE LAWS THAT ARE PERMITTED WILL APPLY TO YOU.

Monetary Cap on liability

YOU ACKNOWLEDGE AND AGREE TO THE FULLEST EXTENT PERMITTED BY APLLICABLE LAW ONLINE DRIVERS INC. AGGREGATE OR THIS WEBSITE LIABILITY SHALL NOT EXCEED THE GREATER AMOUNTS ACTUALLY PAID BY YOU TO ONLINE DRIVERS INC. UNDER THIS AGREEMENT FOR PRODUCT(S) OR SERVICE(S) IN A TWELVE (12) MONTH PERIOD PRECEDING THE EVENT WHICH GAVE RISE TO SUCH CLAIM.

In accordance with these terms and conditions Online Drivers Inc. grants you a personal, limited, non-exclusive, and non-transferable license to access course content during the membership period you have purchased in your shopping cart. Once your membership has expired, the personal, limited, non-exclusive, and non-transferable license that Online Drivers Inc. has granted you access is revoked immediately.

User Content

By submitting any content to us (“User Content”) including any comments, photos, videos, survey responses, or any other content to us via email, social media, contests, or any other platforms available to you with the use of our products or services. You grant Online Drivers Inc. the license to use, modify and display your user content on any platform and associate your user content with your name. The license herein which you grant to Online Drivers Inc. is irrevocable and royalty free. You warrant that any user content does not and shall not infringe on any intellectually property of any individual person, group, company, institution, or organization in any matter. You express that you have the right to submit user content to Online Drivers Inc. and the right to grant us the license herein.

Online Drivers Pass Guarantee

Online Drivers Instructors coaching techniques, expertise, and knowledge of Road Test criteria allows us to provide customers to recieve a full road test re-booking payment for those who do not pass their official G2 or G road test examination. Our Online Drivers Pass Guarantee will be provided to customers who meet the following conditions:

1. The customer must purchase the G2 or G Pass Package.

2. The customer must have paid in full. Payment plan customers must have completed all scheduled payments.

3. The customer must fail their official G2 or G road test at a Drive Test facility and email a copy of their official scoresheet to [email protected] within 30 days of failing their examination.

Once the customer has completed steps 1-3 stated above we will cover the cost associated with re-booking a road test. Re-booking will be done through the official Drive Test Website only. We will not re-book through any other third party websites associated with road test bookings.

Course Package/Lesson Fees

Costs of product(s) and service(s) are represented on the website. You will be charged a one time payment for the Course Package(s), Single Lesson(s) or Mock Test(s) purchased from your shopping cart on the date of Purchase. You agree to make full payment for the Course Package(s), Single Lesson(s) or Mock Test(s) that are listed in your shopping cart, the confirmation billing receipt will be provided to you via your email account once you have completed ordering the Course Package(s), Single Lesson(s) or Mock Test(s) listed in your shopping cart.

For Course Package(s) Payment Plans you will be charged an equal monthly fee for 2 consecutive months from the date of Purchase. All Payment Plans are interest free. You agree that the same credit card used for initial purchase will charged the same amount every 30 days from the date of purchase for 2 consecutive months. If your credit card/paypal payment transaction is declined the second month from the date of purchase or any month thereafter. There will be a Late Fee of $29.99 payable to Online Drivers Inc for each and every month we are unable to process transaction fees.

During promotional periods, free trial lessons may be offered to customers who sign up with Online Drivers Inc. All free trial lessons are subject to expiration. Once the free trial lesson has expired, you will no longer have access to any of the content offered for free. Your account will remain open but any content available for free during the promotional period will not be accessible. You must purchase any of the products or services in your shopping cart to access any other content.

All product and services purchased in your shopping cart are subject to all applicable taxes (GST/HST). You are responsible for paying all applicable taxes.

All prices for product(s) and or service(s) are subject to change. Online Drivers Inc. have the right to change prices at any given time only prior to purchasing the product(s) or service(s) in your shopping cart. Once you have purchased products or services in your shopping cart. The prices at the time of purchase will remain as seen in your shopping cart.

Refunds

There are No refunds for Driving Lesson(s) or Packages, once the first in car lesson has been completed with an Online Drivers Instructor. Refunds must be requested prior to completing the first in car lesson.

Once you have purchased any of the BDE Course(s) you will immediately receive access to all content. Refunds are not available once you have started the Virtual BDE Course(s). Refunds must be requested before starting the BDE Course(s). If there are any technical issues in regards of receiving any of the BDE Course(s) please contact [email protected] immediately and a Online Drivers member will troubleshoot the issue.

To request a refund please email [email protected] . Refunds will be processed immediately. Please allow up to 5-10 business days for the refund to be settled. There is a 3% refund processing fee of the total purchase.

Mississauga and Brampton Residents Only

Course product(s) and service(s) are for Mississauga and Brampton, Ontario residents only. If you are not a resident of Mississauga or Brampton, Ontario and still choose to purchase any of the product(s) and service(s) and later request a refund you will charged a 10% refund/cancellation fee.

Free Courses

G1 Test Prep is Free to customers who keep their account active. The term "Active" relates to the activity course content use. If you do not actively use the content for 365 days consecutively, then your account will become disabled.

The free "Uphill Parking Lesson" is a free 7 Day trial. Once the trial expires you will no longer have access to the "Uphill Parking Lesson" content.

Membership Expiration/Cancellations

All Test Prep Course(s), product(s), and services(s) are subject to expiration dates. These expiration dates vary from Course(s), product(s) and or service(s). Duration of these course(s), product(s) and service(s) are clearly outlined on this website(s). After purchasing your course(s), product(s) and or service(s) you can view your expiration date under your “My Account” page.

You are free to stop using website(s), product(s), and service(s) at any time. You can cancel your membership at any time by going to “My Account" and selecting "Cancel Membership”.

Passwords

Once you have set up an account with Online Drivers Inc., you will prompted to choose a password to access your account. You are responsible for maintaining security of your password. You are solely responsible for your password for any use of your account, the protection of your account, and the activity of your account. Online Drivers Inc. has the right to terminate your account at any given time if Online Drivers Inc. becomes aware of any fraudulent activity, suspicious activity, misrepresentation, inactivity for 12 months or sharing of your password with third parties or for any reason at the sole discretion of Online Drivers Inc.

If you are a parent or guardian registering an account for your child under the age of 18, it is permissible for you to share your password with your child under 18 whilst abiding by the provisions set forth in this agreement.

Arbitration and Class action waiver

Should you choose to take legal action against Online Drivers Inc. arising from any dispute of this agreement, arbitration shall take place in any provincial or federal court within Ontario, Canada.

This agreement is strictly between you and Online Drivers Inc. Should you choose to take legal action against Online Drivers Inc. You acknowledge and proclaim to waive your rights or ability to join a claim arising in any disputes or claims against Online Drivers Inc. as a plaintiff in any class actions. You may not join any class action, class arbitration or any private attorney actions against Online Drivers Inc., Online Drivers Inc. affiliates, shareholders, or officers. Amalgamate arbitration are strictly prohibited by this agreement.

If any court deems any part of this agreement as unenforceable. The part which is deemed unenforceable shall be stricken from the agreement whilst the rest of the agreement is deemed enforceable and shall remain in full effect.

General

Online Drivers Inc. reserves the right to change, modify, or remove any provisions found in this agreement between you and Online Drivers Inc. Updated Terms and conditions are not retroactive. The most current terms and conditions found under “terms and conditions" on our website(s) governs our agreement. You acknowledge and accept that you are bound to the updated Terms and Conditions as they become available by continuing to use or access and part of our website(s), product(s), or service(s) in any matter.
